Road Traffic Accident Compensation Claims - Case Studies

Case study 1

Our client, a cyclist, was knocked from his bike as another vehicle pulled out at a junction. The driver alleged her view was blurred by a car turning left. Our client was thrown over the front of the car and was seriously injured.

He was taken to hospital and following an emergency operation had a kidney removed. Medical evidence was obtained from consultant urologist to determine the claimant's level of kidney function.

The defendants denied liability and alleged our client was "Speeding, the third parties view was obscured and that he was riding in the middle of the road".

They were seeking to reduce the claimants claim by 50%. Following a visit to the scene of the accident, photographic evidence and detailed witness statements from five witnesses to the accident were obtained and dislosed. The Defendant subsequently admitted full liability and settled the case.

Case study 2

Our client, a horse rider was involved in a Road Traffic Accident in 2002 where she sustained crushed thumbs. She required restorative surgery as the injury to her dominant thumb prevented her from carrying out her passion for horse riding and caring for horses.

We were able to persuade the third party driver's insurers to admit liability for the accident promptly leaving only the issue of how much compensation she should receive.

The defendants were required to pay for the cost of the restorative surgery. Following this surgery, our client was able to purchase the horse that she had dreamed of and she can now enjoy riding again following the success of the surgery.

The claim was subsequently settled out of Court preventing "H" from having to attend a trial and the settlement enabled "H" to purchase a new car and to secure gainful employment.
